Why your 40th email today gets judged differently than your 4th
Real research on decision fatigue — from parole judges to online shoppers — and what it means for when a cold email lands, not just what it says.

A cold email doesn’t get read in a vacuum. It gets read as item 4, or item 40, in whatever queue the recipient is working through that day — and the research on how people make repeated decisions says that position changes the verdict, independent of what the email actually says. This isn’t a metaphor. It’s been measured, on decisions with far higher stakes than whether to reply to a stranger.
The judge who says yes right after lunch
The clearest demonstration comes from a courtroom, not an inbox. Shai Danziger, Jonathan Levav, and Liora Avnaim-Pesso studied 1,112 parole board rulings made by eight experienced Israeli judges over ten months. Each judge’s day was split into three sessions by two food breaks. Right after a break, judges granted parole in roughly 65% of cases. By the end of each session — as the judges worked through case after similar case with no rest — the favorable-ruling rate drifted down, in some stretches close to zero, before snapping back up to around 65% the moment the next break ended.

Nothing about the cases changed systematically as the day went on. What changed was the judge’s position in a sequence of similar decisions. The authors’ own cautious interpretation is that mental depletion pushes decision-makers toward the easier, lower-effort default — and in a parole hearing, denying parole (the status quo) takes less deliberation than granting it. The paper is observational, and the authors are careful to say they can’t fully rule out other explanations — but the break-reset pattern, repeating across eight judges and ten months, is hard to explain any other way.
What “decision fatigue” actually claims — and what’s contested
The judge study gets filed under “decision fatigue,” a term that traces back to Roy Baumeister’s research on ego depletion — the idea that self-regulation and effortful choice draw on a limited resource that depletes with use, the way a muscle tires. It’s worth being honest about where this stands scientifically: ego depletion is one of the more contested findings in social psychology. A 2015 meta-analysis and a large multi-lab replication in 2016 both found the effect was smaller and less reliable than the original research suggested, and the debate hasn’t fully settled.
That doesn’t erase the judge data, which is a separate, more narrowly scoped finding about real, high-stakes, repeated professional decisions — it just means “willpower is literally a fuel tank” is the wrong mental model. The safer, better-supported version: repeating a similar decision, over and over, without a break, measurably shifts people toward the lower-effort default — whatever that default happens to be. In a parole hearing, the default is “deny.” In an inbox, the default is “archive without reading.”
The related, messier finding: too many options
A second, more contested piece of the puzzle is choice overload. Sheena Iyengar and Mark Lepper’s 2000 jam study found shoppers offered 6 jam flavors bought at a 30% rate, versus 3% when offered 24 flavors — more options, fewer decisions actually made. It’s a famous result and a contested one: a later meta-analysis of 50 choice- overload experiments found the average effect across all of them was close to zero, meaning the jam result doesn’t reliably replicate in every context. The honest reading isn’t “more options always backfire.” It’s narrower: under the right conditions — similar-looking options, limited time, no clear way to compare them — an abundance of similar choices can raise the mental cost of deciding at all, and the easiest way to lower that cost is to decide nothing.
The inbox is that setup
A B2B inbox is a sequence of similar decisions — open or not, reply or not — arriving over 120 times a week for the average buyer, according to Sopro’s 2026 research. Every unsolicited email competes not just against its own merits, but against the reader’s position in that day’s queue. Email 4 gets read with intact judgment. - A great email sent at the wrong moment in someone’s day loses to the fatigue effect, not to the copy. The best time to send cold email isn’t just about open rates — it’s about landing before the recipient’s queue has worn their judgment down for the day.
- Frequency compounds the same effect against you. Every additional email from every additional vendor adds another decision to the same daily queue. You don’t control the other 39 emails, but you do control whether your own follow-up cadence adds unnecessary volume to a system that’s already pushing recipients toward the default answer: no.
What to actually do with this
None of the research above says “send less” as a blanket rule — the data on follow-up sequences roughly doubling reply rate still holds. It says something more specific: be deliberate about when in someone’s day and week you’re competing for a decision, because the same email can get a fair hearing or a defaulted “no” depending entirely on what queue it lands in. Concretely, that means:
- Favor mid-morning sends, when a recipient’s queue for the day hasn’t built up yet, over late-afternoon sends competing with a full inbox.
- Keep each individual email genuinely easy to decide on — the studies above suggest complexity is what pushes a tired decision-maker toward the default, so a clear, single, low-effort ask survives fatigue better than a multi-paragraph pitch does.
- Don’t confuse “no reply” with “no.” A quiet inbox on a heavy sending day is at least partly a measurement artifact, not always a verdict on your offer — which is exactly why replies trickle in over days, not hours.
